DİYARBAKIR - The letter HDP sent to Diyarbakır MP Musa Farisoğulları whose MP status was stripped, has been confiscated by the prison administration on grounds that it was 'propagandizing an illegal organization'.

 

Peoples' Democratic Party (HDP) Diyarbakır MP Musa Farisoğulları, whose status as an MP was stripped with the votes of AKP and MHP following the finalization of the prison sentence decision handed to him in scope of the KCK Main Case, told that the letters sent by his party to Diyarbakır Type D Closed Prison was confiscated by the prison administration. 

 

He objected to the decision regarding the confiscation of the letters by the prison administration with a petition to the Execution Judge. Farisoğulları stated that in the decision notified to him on September 5, the letter was alleged to contain "propaganda of an organization".

 

'VIOLATION OF FREEDOM OF COMMUNICATION'  

 

Stating in the petition that the "freedom of communication", which is a constitutional right, was violated and the decision lacked any basis, Farisoğulları said: "Fundamental rights and freedoms are not ordinary rights. For this reason, the restriction of these rights must be legal. It cannot be restricted by the principles determined by an ordinary institution or the article of its regulation. The restriction must be strictly legal. The confiscation of these letters by the prison administration is an arbitrary violation of the right to communicate, which is a basic right."

 

Pointing out that he did not apply to the prosecutor's office regarding the accusation made by the prison administration, Farisoğulları said: "The propaganda of the organization that the prison administration has mentioned and presented as a reason needs to be explained. It is doubtful whether the situation in question was a crime or not. Prison administration is an administrative institution as it says in its name. If there is such a crime, why didn't they apply to the prosecutor's office? This is an arbitrary application. The sender is Peoples' Democratic Party (HDP) and I am an MP of this party. My party making propaganda of itself to me is absurd."

 

Farisoğulları demanded that the decision of the Execution Judge to confiscate the letters be lifted in his petition.
