World sees Cizre while judiciary ignores

ŞIRNAK - No visible developments occured in the case of the basements of Cizre where 177 people were burnt alive. Judiciary ignores the case despite hundreds of concrete evidence, sound and image files.

 
4 years have passed since the curfew  declared in Şırnak's Cizre and Silopi districts on December 14, 2015. The city was destroyed during the 79 day curfew with tanks and armoured vehicles. The words of Cizre Peoples Assembly Co- Chair Mehmet Tunç was committed to the memories when he said: "We did not kneel. The people left behind must be proud of us.' 177 of 288 people were burnt alive in 3 different basements including Cizre Peoples Assembly Co- Chairs Mehmet Tunç and Asya Yüksel and baby Miray who were murdered with her grandfather. More than a total of 288 people lost their lives in the city left in ruins. These datas surfaced due to the applications of the families who lost their loved ones. But those who lost their lives are more than 288 in numbers.
 
 
According to the reports of humans' rights organizations, 22 of the murdered people are women 41 of them are children and one is a baby. Cemile Çağırga, who lost her life during the curfew came up with the fact that her body was kept in the freezer for 3 days because her family was not able to get out of the house to bury their daughter due to the soldiers firing at them. Hüseyin Tül, one of the lawyers of those who lost their lives during the curfews in Cizre evaluated the legal developments to Mesopotamia Agency (MA).
 
 
VIOLATIONS CONTINUED AFTER THE CURFEW
 
 
Stating that many violations of rights occured with the curfews, Tül said: " The right to education, freedom, security, health and most importantly the right to life was violated. And these were not just violations that occured during the curfews. There have been people losing their lives after the curfews. The violations continued." Tül, stating that they still don't know the exact number of those who lost their lives in Cizre, stated that at least 16 people are still not identified.
 
NO SINGLE 'SUSPECTS'
 
Tül, emphasizing that what needed to happen first was the prosecutor's office to act on their on account and collect evidence, said: "No single prosecutor visited the crime scene despite our insistance.  At that time many non-governmental organizations and lawyers organizations came from all over Turkey. Despite our meeting with the Attorney General, it was inconclusive and no single crime scene investigation was done with the participation of a prosecutor. In this sense, the people who collects evidence is very important and in Cizre case, the police officers who might be involved in those killings collected the evidence. The evidence were spoiled maybe even planted by the police. And unfortunately, despite the passing 5 years, there is no single suspects in the case like those people dropped dead on their own account, while those who died in Cizre were labelled as 'members of a terrorist organization'"
 
 
Attorney Tül, stating that the point of view of those who carry out the investigation presented itself the minute the investigation started, said there is no evidence for the reasons given by the prosecution offices. Noting that there is evidence to refute the prosecution's claims, Tül stated that there are cameras on the armored vehicles, tanks and unmanned aerial vehicles used at that time. However said Tül, those images are not in the files for 'security reasons'. Tül stating that they know those images exist, said ECHR rejected the case stating that the domestic remedies have not yet been exhausted.  Tül added that they understand these images exist by examining Turkey's defense in ECHR. Tül finally said: " We have made applications for AYM and we continue to do so. Ultimately, we intend to take it to the ECHR. Of course, running these legal processes is unfortunately not effective in finding the perpetrators."
