Durakoğlu: An anti-democratic regulation that leaves those who are initially must be released in prison

İSTANBUL - Istanbul Bar Association President Mehmet Durakoğlu said that the amendment on the regulation of execution does not meet the expectations of the society and said: "This regulation is an anti-democratic anti-democratic regulation that leaves those who are initially must be released in prison."
 
The 70 articled Amendment on the regulation of execution in certain laws, which envisages a change in the Law of Enforcement prepared and submitted by the AKP and MHP to Parliament, was accepted by the Parliamentary Justice Commission. With the regulation, 90 thousand people are expected to be released, while political prisoners are excluded from the regulation. Mehmet Durakoğlu, the President of the Istanbul Bar, evaluated the legislation adopted by the Commission.
 
IT DOESN'T MEET THE EXPECTATIONS
 
Stating that the legislation passed by the commission did not meet the expectations of the society, Durakoğlu added that there was a great expectation in the society especially after the epidemic and said: "While there are so many lawyers, politicians, thinkers and journalists inside, their detentions had to be revised, but this was not done. Can you imagine, people are in prison for what they think, what they wrote and they will continue to be imprisoned. Those who murder people, those who sell drugs, those who committed violence against women will be released. This can no way be acceptable in social conscience."
 
AN ANTI-DEMOCRATIC APPROACH
 
Durakoğlu, stating that there could be prison sentence for those who are sentenced to less than 18 months, such as people sharing their thoughts on social media, said: "This needs to be clarified. While the punishments on organized crimes are made more severe, the actual crimes will be able to benefit from this regulation.  These contradictions need to be resolved. This needs to be corrected in the commission. A law to be enacted in this framework does not constitute an democratic approach. This regulation ensures a segment of the society to be freed while leaving those who are initially must be released in prison."
 
AUTHORIZATION OF JUDGES OF EXECUTION
 
Evaluating the expanded authority given to the judges of execution, Durakoğlu said: "This is the only positive regulation in the proposed law. With the new regulation, probation will be evaluated by a commission. This is a right thing to do but not enough. The members of the commission and their approaches will be very important. Therefore, there must be lawyers and bar associations in the commission. If the commission is established by the people from the government, there will be other problems. This needs to be clarified."
